10-Year Good Faith Possession of Real Estate Established Basis for Ownership Recognition – Another Victory for AM

The client had lived for years at the disputed address with her husband. After he left the country, she continued to use the apartment alone, taking care of its maintenance and covering all necessary expenses.

Her good faith, open, and uninterrupted possession continued for more than 10 years, which became the basis for recognizing her ownership rights.

The court, relying on the written evidence and witness testimonies presented by AM Law Firm, confirmed that the husband’s prolonged inactivity indicated a relinquishment of ownership rights over the apartment, while the client’s possession was deemed good faith and continuous.

As a result, the Court of First Instance upheld the claim and recognized the citizen’s ownership of the real estate based on acquisition through long-term possession, with her interests represented in court by Arman Nersisyan, Senior Legal Counsel and Attorney at AM Law Firm.
