The Client’s Full Ownership Right Was Secured Through Court Proceedings AM Successfully Resolved an Inheritance Dispute

A client who applied to our office was unable to exercise their inheritance rights following the death of their mother. Inaccuracies in the documents, as well as a dispute with another heir, were hindering the process of formalizing the inheritance.

The case was handled by attorney Paytsar Kocharyan, who undertook the necessary legal actions to formalize the inheritance. As a result, the notary issued a Certificate of Inheritance, on the basis of which the client’s ownership right was registered.

However, the other heir intentionally avoided appearing at the notary’s office to receive their certificate, while simultaneously demanding half of the property. In order to resolve the situation, a strategic decision was made to apply to the court with a claim to terminate the latter’s ownership right through compensation.

It was taken into account that the defendant’s share was insignificant, could not be physically separated, and that the defendant did not have a substantial interest in the use of the common property.

During the trial, substantiated evidence was presented, expert examinations were conducted, and the client’s share in the property was increased as other co-owners donated their shares to the client.

After evaluating the submitted arguments and evidence, the court satisfied the claim and terminated the defendant’s rights to the property in exchange for compensation. As a result, after depositing the court-determined amount into the notary’s deposit account, the client registered ownership over the entire property and obtained the full right to dispose of itwithout any obstacles.
